The VAT (KDV) Exemption Rule

Under Turkish tax law (KDV Kanunu Article 13/i), foreign nationals who meet certain conditions are fully exempt from VAT on new property purchases. This can save between 1% and 18% of the property price — a significant saving on a $400,000+ investment.

Who Qualifies?

You qualify for VAT exemption if you are:

  • A foreign national (non-Turkish citizen), AND
  • Not resident in Turkey (no Turkish residency permit), AND
  • Paying in foreign currency (USD, EUR, GBP, etc.), AND
  • The funds are remitted from abroad to a Turkish bank account
  • Which Properties Are Eligible?

    VAT exemption applies to:

    • New-build residential units from developers
    • GYO (REIT) exempt projects — these are the most straightforward
    • Properties purchased directly from the first sale
    VAT exemption does NOT apply to:
    • Resale (second-hand) properties
    • Commercial properties in some cases
    • Properties where funds are paid in Turkish Lira

    For GYO-exempt projects (clearly marked in project listings), the saving is smaller (1%) but the process is simpler.

    Required Documents

  • Passport + Turkish tax number
  • Bank receipt showing foreign currency transfer from abroad
  • Currency Exchange Certificate (Döviz Alım Belgesi — DAB)
  • Proof of non-residency (statement or absence of residence permit)
  • Notarial declaration
  • The Process

    The developer's legal team handles the VAT exemption paperwork. When choosing a project:

    • Look for "GYO Exempt" or "VAT Free for Foreigners" flags
    • Confirm with the developer that they support foreign buyer VAT exemption
    • Transfer purchase funds in foreign currency directly to developer's account
    • Receive invoice with 0% VAT

    Important: The 1-Year Rule

    If you sell the property within 1 year of purchase and received VAT exemption, the VAT becomes payable. If you hold for 1+ years, the exemption is permanent.

    How Much Can You Save?

    On a $500,000 luxury apartment (net area >150m²):

    • Standard VAT at 18% = $90,000
    • With exemption = $0
    • Saving: $90,000
    On a $400,000 standard apartment (GYO project):
    • Standard VAT at 1% = $4,000
    • With exemption = $0
    • Saving: $4,000
